IMMIGRATION UNIT

Legal Aid Service of Collier County’s Immigration Unit provides assistance to income eligible residents of Collier County, especially to the community’s vulnerable immigrant population in the following areas:

We assist immigrant victims of domestic violence, victims of trafficking in persons, and victims of other violent crimes, in obtaining lawful immigration status.

We represent abused, abandoned, or neglected immigrant children in their applications for lawful permanent residence. 

In removal proceedings in immigration court, we represent clients with meritorious defenses such as adjustment, cancellation, political asylum, and NACARA.

We also work at family reunification through family petitions and visa practice, especially for families of farm workers.

HELPFUL RESOURCES

You may call the Immigration Court Information System (The Executive Offices for Immigration Review or EOIR) computer phone at 1-800-898-7180 for the next scheduled court date, results of immigration court of appeals decisions.  Have your alien number ready to input.

Citizenship and Immigration Services’ (CIS) web site is at:  www.cis.gov where forms, instructions, and useful information are available, such as processing dates for action on petitions.  With a receipt number (you can find this on the tip left of CIS receipts), you can find out the status of your application.  The web site has the new citizenship exam information.

Remember, all non-citizens must file form AR11 within ten days of moving to a new address.  If any applications are pending, notice of the new address must be sent to the appropriate CIS office where the application is pending. 

Visa processing dates can be found at www.state.gov.  Click on “visa”, then “Visa bulletin”  to get the current month’s list of priority dates ready for each preference category.  Spouse, parents and children that are under 21 years of age and unmarried children of US citizen petitioner are immediate and once approved need not wait for a priority date to be ready. 

The preference categories are:

First:        Over 21, unmarried sons or daughters of a U.S. citizen
Second:    (2A) a spouse and single under 21 year old child of a legal permanent resident. 
Third:       Married son or daughter of a U.S. citizen
Fourth:     Brother or sister of a U.S. citizen
